1. Acceptance of Terms
By accessing and using BookSmart Accounts ("the Software"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.
2. Description of Service
BookSmart Accounts provides cloud-based accounting, inventory, and GST compliance software for Indian businesses. We reserve the right to modify, suspend, or discontinue the Service with or without notice at any time.
3. User Accounts
To use the Service, you must register for an account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Subscription & Billing
The Service is billed on a subscription basis (Monthly or Annually). You will be billed in advance on a recurring schedule.
5. Data Ownership
We claim no intellectual property rights over the data you upload to the Service. Your data remains yours. However, by using the Service, you grant us permission to host and back up your data to provide the Service to you.
6. Limitation of Liability
In no event shall BookSmart Accounts, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
7. GST & Tax Liability
While the Software is designed to help with GST compliance, you are solely responsible for the accuracy of your tax returns and timely payment of your taxes. BookSmart Accounts acts only as an enabler and is not liable for any penalties levied by the tax department due to incorrect data entry by the user.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, specifically the jurisdiction of Gujarat courts, without regard to its conflict of law provisions.
