Don't panic: How to handle a GST notice from the department
Receiving a notice (like ASMT-10) is stressful. But in most cases, it's just an automated computer mismatch. Here is how to resolve it calmly.
You log into your GST portal and there it is—a flashing red alert. You have received a Notice from the tax department. Your heart drops. Do you need to hire an expensive lawyer? Is your bank account going to be frozen? Take a deep breath.
1. Understand Why You Got It
The GST system is heavily automated. 90% of notices are automatically generated by the portal's algorithms, not by an angry tax officer. The most common notice is ASMT-10. This usually triggers for two reasons:
- Mismatch 1: The sales you declared in your GSTR-1 don't match the taxes you paid in GSTR-3B.
- Mismatch 2: The Input Tax Credit you claimed in GSTR-3B is higher than what is showing in your auto-drafted GSTR-2A/2B.
2. Check the Deadline
Never ignore a notice. If you ignore an ASMT-10, it will escalate to a "Show Cause Notice" (DRC-01), which is much more serious. You typically have 15 to 30 days to reply. Note the deadline immediately.
3. Reconcile Your Data
Don't just blindly pay the amount they are demanding. Sit down with your software. If they claim you took excess ITC, pull up your purchase register for that month and do a line-by-line comparison with the portal's GSTR-2A.
Usually, you will find a simple error. Maybe an invoice was accidentally entered twice, or a supplier uploaded an invoice into the wrong month.
4. Formulating the Reply (Part B)
If the department is right (you made a mistake), simply pay the tax difference along with any applicable interest using form DRC-03, and inform the officer. Case closed.
If the department is wrong (your records are correct), you need to file a reply using form ASMT-11. Attach a polite letter explaining the facts, along with supporting documents like a CA-certified reconciliation statement or copies of tax invoices. Once the officer reads your explanation and is satisfied, they will drop the proceedings by issuing an ASMT-12 order.
